1. Who You Are Dealing With

1.1Property Pathway is operated by Roxanne Alterio, a sole trader in Queensland, Australia (ABN 80 241 124 181). In these terms "I", "me" and "my" mean Roxanne Alterio, and "you" means the person buying from or using this site.

1.3By buying from this site, or using the free tools on it, you accept these terms. If you do not accept them, do not use the site.

2. What I Sell

2.1Online courses, written guides, spreadsheets, templates, calculators and checklists about buying and owning residential property in Australia ("Materials"), and written research on individual addresses ("Property Reports"). Together, the "Products".

2.2All Products are educational. They are not advice.

3. What I Am, and What I Am Not

3.1This is the most important clause in this document.

3.2I hold a real estate agent licence under the Property Occupations Act 2014 (Qld). That licence permits me to deal in property. It does not permit me to advise you about money.

3.3I do not hold an Australian Financial Services Licence under the Corporations Act 2001 (Cth) and I am not authorised to provide financial product advice. I do not hold an Australian Credit Licence under the National Consumer Credit Protection Act 2009 (Cth), so I cannot suggest a credit product, assess your borrowing capacity, or tell you a product is suitable for you. I am not an accountant, a registered tax agent, a certified practising valuer or a legal practitioner.

3.4Nothing on this site is personal advice. It does not take your objectives, financial situation or needs into account.

3.5Property carries risk. Prices fall as well as rise, finance is declined, and interest rates move. I do not guarantee any saving, approval, return or increase in value.

4. No Agency Relationship

4.1Buying a Product does not make me your agent.

4.2I act for sellers. I will not represent you, negotiate on your behalf, attend inspections with you, bid for you, or contact another agent for you. No retainer, appointment or agency agreement arises from anything on this site.

4.3No person may act for both the buyer and the seller in the same transaction. What I sell is education and research, which you apply yourself.

5. The Calculators and Free Tools

5.1The calculators and tools are teaching aids built on simplified assumptions. They are not quotes, approvals, valuations or tax calculations, and no lender, insurer or revenue office is bound by them.

5.2Transfer duty scales, concessions and lending rules change and differ between states, property types and price brackets. You must confirm any figure that matters with your state revenue office, a licensed broker, your conveyancer or your accountant.

5.3Data you enter into the calculators and the Open Home Log is stored in your browser only. It is not transmitted to me and I do not hold it.

6. The Property Report

6.1A Property Report is a written research summary about one address, prepared by me from public records, listing data and market comparables.

6.2A Property Report is not a valuation under any professional standard, a building or pest inspection, a title or contract search, a survey, a flood certificate, or legal, financial or tax advice. It does not replace any of those and you should obtain them separately.

6.3Flood, bushfire and planning findings reflect public mapping as at the date of the report. Mapping is revised and actual events may exceed modelling. I do not warrant that a property will or will not flood, be approved for development, or be insurable.

6.4If I or my agency are engaged to sell the property you submit, or hold any interest in it, I will disclose that to you and refund you rather than prepare the report.

6.5You may use a Property Report for your own decision. You must not publish it, resell it, or provide it to any third party as an independent valuation or inspection.

7. Access and Licence

7.1On payment you receive a personal, non-exclusive, non-transferable licence to use the Materials for your own purposes.

7.2"Lifetime access" means for so long as I continue to offer that Product, and includes updates I make to it. If a Product is discontinued I will give you reasonable notice and an opportunity to download it.

7.3You must not share login credentials, resell, publish or distribute the Materials, or use them to train any machine learning or artificial intelligence system.

8. Acceptable Use

8.1You must not use this site to break any law, infringe any right, transmit malicious code, attempt to gain unauthorised access, scrape content at scale, or interfere with its operation.

8.2I may suspend or terminate your access immediately if you breach clause 7.3 or this clause 8. No refund is payable where access is terminated for breach.

9. Intellectual Property

9.1All Materials, including videos, written content, templates, spreadsheets, calculators, frameworks and branding, remain my property or that of my licensors.

9.2Nothing in these terms transfers ownership of any intellectual property to you.

10. Price and Payment

10.1Prices are in Australian dollars.

10.2I am not registered for GST. No GST is charged and my invoices do not include any. If that changes I will update this clause and my prices.

10.3Payment is processed by third party payment providers. I do not receive or store your card details.

11. Refunds and Consumer Guarantees

11.1My Products come with guarantees that cannot be excluded under the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).

11.2The Refund Policy forms part of these terms. Nothing in these terms limits or excludes any right you have under the Australian Consumer Law.

12. Testimonials

12.1Any testimonial reflects the experience of the person who gave it. Testimonials are not typical, are not a promise, and are not a prediction of your result.

13. Third Party Professionals and Links

13.1I may refer to or link to brokers, inspectors, conveyancers, solicitors or other professionals. Unless stated in writing, I do not control them and I am not responsible for their conduct or advice.

13.2If I receive any commission or benefit for a referral, I will disclose that to you before making the referral.

13.3A referral is an introduction only. You must satisfy yourself as to the suitability of any person you engage.

14. Liability

14.1Nothing in this clause limits liability that cannot be limited at law, including under the Australian Consumer Law.

14.2Where I am permitted to limit liability, my total liability for any claim connected with a Product is limited, at my election, to resupplying it or refunding the amount you paid for it.

14.3To the extent permitted by law, I am not liable for indirect, special or consequential loss, including loss of profit, loss of opportunity, or loss arising from a property decision you make.

14.4You are responsible for your own decisions, including any decision to make or withdraw an offer.

15. Termination

15.1You may stop using the site at any time.

15.2I may suspend or terminate access for breach under clause 8.2, or on reasonable notice if I cease trading.

15.3Clauses 3, 4, 6, 9, 12, 14 and 17 survive termination.

16. Variation

16.1I may amend these terms. The version applying to a purchase is the version published at the time of that purchase.

16.2Continued use of the site after amended terms are published constitutes acceptance of them.

17. General

17.1Entire agreement. These terms, together with the Refund Policy and Privacy Policy, form the entire agreement between us in relation to the Products and supersede any prior representation or understanding.

17.2Severability. If any provision is held to be invalid or unenforceable, it is severed and the remaining provisions continue in full force.

17.3Waiver. A failure or delay in exercising a right does not operate as a waiver of that right.

17.4Assignment. You must not assign your rights under these terms. I may assign mine on notice to you, provided your rights are not adversely affected.

17.5Notices. Notices to me must be sent to info@propertypathway.au. Notices to you may be sent to the email address on your order.

17.6Force majeure. I am not liable for failure or delay in performance caused by an event beyond my reasonable control, provided I take reasonable steps to mitigate it.

17.7Third parties. No person other than you and me has any right to enforce these terms.

18. Disputes and Governing Law

18.1If you have a complaint, contact me first at info@propertypathway.au. Most matters are resolved this way.

18.2If a matter is not resolved within 30 days, either party may refer it to mediation before commencing proceedings, other than where urgent relief is required.

18.3These terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.

18.4Nothing in this clause prevents you from making a complaint to the Australian Competition and Consumer Commission, the Office of Fair Trading in your state, or the Office of the Australian Information Commissioner.
